These Terms of Service ("Terms") govern your access to and use of GigPulse (the "Service"), a web-based income and expense tracking application for gig economy workers in Canada, operated by GigPulse ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

GigPulse provides tools to help Canadian gig workers (including but not limited to delivery drivers for DoorDash, Uber Eats, Skip The Dishes, and Instacart) to:

• Track income from multiple platforms
• Log business expenses and calculate CRA-compliant deductions
• Estimate taxes owed based on Canadian tax rules (30% default rate)
• Generate reports for tax filing purposes

Important: GigPulse is NOT a substitute for professional tax advice. The tax calculations provided are estimates only. We strongly recommend consulting a licensed accountant or tax professional for personalized guidance.

You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials secure and confidential
• Use the Service only for lawful purposes and in compliance with Canadian law
• Not share your account with others
• Verify all calculations and data before relying on them for official tax filings

Prohibited Activities:

• Attempting to hack, reverse engineer, or disrupt the Service
• Using automated tools (bots, scrapers) to access the Service
• Uploading malicious code or viruses
• Misrepresenting yourself or providing false information

GigPulse operates on a subscription model with a 14-day free trial. After the trial:

• Pro Driver Plan: $12.99 CAD per month
• Billing occurs automatically on your renewal date
• You may cancel anytime via the Settings page
• Cancellations take effect at the end of the current billing period
• No refunds for partial months

We take your privacy seriously. Your data is stored securely using Supabase (a SOC 2 Type II certified provider) and is encrypted both in transit and at rest.

• We will never sell your personal data to third parties
• You retain ownership of all data you input into GigPulse
• You may export or delete your data at any time
• We comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA)

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of tax calculations
• Uninterrupted or error-free operation
• Freedom from viruses or harmful components
• Fitness for a particular purpose

You acknowledge that GigPulse is a tool to assist with record-keeping, not a replacement for professional accounting or tax services. We make no guarantee that using GigPulse will result in tax savings or CRA compliance.

TO THE MAXIMUM EXTENT PERMITTED BY CANADIAN LAW, IN NO EVENT SHALL GIGPULSE BE LIABLE FOR:

• Loss of profits, revenue, or data
• Indirect, incidental, or consequential damages
• Errors in tax calculations or missed deductions
• CRA audits, penalties, or interest charges
• Service downtime or data loss

Our total liability for any claim arising from your use of GigPulse shall not exceed the amount you paid us in the 12 months preceding the claim (maximum $107.88 CAD).

Either party may terminate this agreement at any time:

• You may: Cancel your subscription via Settings → Account → Cancel Subscription
• We may: Suspend or terminate your account if you violate these Terms or engage in fraudulent activity

Upon termination, you will lose access to the Service. We recommend exporting your data before canceling. We are not obligated to retain your data after account closure.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Continued use of the Service after changes constitute acceptance of the new Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario. If any provision is found unenforceable, the remaining provisions remain in full effect.
